This document forms a legally binding agreement between you (“the Client”) and Belle-Vous Boudoir Photography (“the Photographer”) upon payment of your session fee.

1. Agreement & Acceptance

1.1 By making payment, you confirm that you have read, understood, and agreed to these Terms & Conditions.
1.2 You confirm that you are at least eighteen (18) years of age and legally able to enter into this agreement.
1.3 This agreement is governed by the laws of Queensland, Australia.

2. Booking & Payment

2.1 Full payment is required to secure your session date.
2.2 Session fees are non-refundable, as your booking reserves exclusive studio time and prevents other bookings being accepted for that date.
2.3 All pricing includes GST and is subject to change without notice until payment is received.
2.4 Any chargeback or payment dispute initiated without first contacting Belle-Vous in writing to resolve the matter will be treated as a breach of contract. You agree to be responsible for any associated recovery costs or fees.

3. Cancellations & Rescheduling

3.1 You may reschedule your session once with at least 7 days’ written notice.
3.2 Rescheduling requests made within 7 days of the session may incur a $150 rescheduling fee.
3.3 Cancellations within 72 hours of your session, or failure to attend, will result in forfeiture of all monies paid.
3.4 Rescheduled sessions must take place within three (3) months of the original date unless otherwise agreed in writing.

Nothing in this clause excludes your rights under Australian Consumer Law.

4. Artistic Style & Editing

4.1 You acknowledge that you have reviewed our portfolio and understand the artistic style of Belle-Vous Boudoir Photography.
4.2 The Photographer retains full creative control over lighting, posing, editing style, and final image selection.
4.3 Only purchased images will be fully retouched and delivered.
4.4 RAW or unedited images will not be provided under any circumstances.

5. Image Selection & Products

5.1 Your session includes five (5) retouched digital images unless otherwise stated in writing.
5.2 Additional images and products may be purchased at your reveal session.
5.3 All digital image and product sales are final once confirmed.
5.4 Custom products (albums, prints, folio boxes, etc.) cannot be refunded or exchanged once sent to production unless required under Australian Consumer Law.

6. Copyright & Usage

6.1 Belle-Vous Boudoir Photography retains full copyright in all images created.
6.2 You are granted a personal-use, royalty-free, perpetual licence for purchased images only.
6.3 You may print and share your purchased images for personal use.
6.4 Images may not be altered, filtered, re-edited, commercially sold, or supplied to third parties for commercial use without written permission.
6.5 Providing images to vendors, publications, or third parties without written consent constitutes copyright infringement and may result in compensation claims.

7. Privacy & Image Release

7.1 Your privacy is respected at all times.
7.2 No images will be published, displayed, or shared publicly without your written consent.
7.3 If consent is granted, you may withdraw permission for future promotional use by written notice.

8. Studio Conduct

8.1 Belle-Vous Boudoir operates a private, safe working environment.
8.2 No additional guests are permitted unless approved in advance.
8.3 Aggressive, abusive, threatening, or inappropriate behaviour (including harassment or sexual misconduct) will result in immediate termination of services without refund.

9. Liability & Indemnity

9.1 All care and diligence will be exercised in providing services.
9.2 In the unlikely event of equipment failure, data loss, theft, accident, illness, or other unforeseen circumstance preventing fulfilment of this agreement, liability is limited to a refund of monies paid.
9.3 Belle-Vous is not responsible for personal injury sustained during posing, movement, or participation in the session. Participation is at your own risk.
9.4 You agree to indemnify Belle-Vous Boudoir Photography against claims arising from your participation except where caused by our negligence.

Nothing in this clause excludes liability that cannot be excluded under law.

10. Force Majeure

We are not liable for failure or delay in performing services due to events beyond reasonable control including but not limited to natural disasters, illness, government restrictions, power failure, or civil disruption.

11. File Retention

11.1 Final edited images are archived for up to five (5) years.
11.2 While reasonable care is taken, long-term file storage is not guaranteed against technological failure or catastrophic loss.
11.3 After five years, files may be permanently deleted.

12. Delivery & Third-Party Services

12.1 Belle-Vous is not responsible for delays, loss, or damage caused by third-party couriers or suppliers.
12.2 Replacement of damaged products is at our discretion except where required by law.

13. Exclusive Photographer

You acknowledge that Belle-Vous Boudoir Photography is the sole professional photographer engaged for your session.

14. Variation of Terms

These Terms & Conditions may be updated at any time. The version in effect at the time of booking will apply to your session.
